The N.C. Court of Appeals on Friday denied the city of Fayetteville’s appeal of a judge’s order that it schedule a referendum on a plan that would add at-large seats to the City Council.

Cumberland County Superior Court Judge Jim Ammons ruled Thursday that a referendum on the Vote Yes election plan be placed on the November ballot to allow voters to decide if they want to change the way the City Council is structured.

The Vote Yes Fayetteville advocacy group is suing the city and the Cumberland County Board of Elections seeking to have its plan to reshape City Council elections put before voters in a Nov. 8 referendum. The civil lawsuit, which asks for a temporary restraining order and preliminary injunction, was filed Tuesday in Cumberland County Superior Court.

A leading supporter of a plan to add at-large seats on the Fayetteville City Council said Tuesday that his organization is not giving up. A motion to put the Vote Yes Fayetteville initiative before city voters in a November referendum was rejected on a 6-4 vote Monday night at a City Council meeting.

Four new members of the Fayetteville City Council were among those sworn in to office Thursday night. The ceremony was held at Seabrook Auditorium on the campus of Fayetteville State University.

The Thursday recount produced the same result. Political newcomer Mario Benavente’s win over incumbent Antonio Jones was verified Thursday in a Cumberland County Board of Elections recount of the vote for the District 3 Fayetteville City Council seat.
